The changes in the criteria for access to financial assistance in the purchase of private health insurance are due to the regulations issued by CMS and federal appropriation laws (including the updates contained in Public Law 119-21 and regulations of the U.S. Department of Health and Human Services - HHS). These provisions strictly define which categories of legal presence qualify for the receipt of federal tax credits.

Effective January 1, 2027, a clear differentiation is made between maintaining the legal right to purchase a plan within the ACA Marketplace platform and being entitled to receive government financial assistance known as the Premium Tax Credit (PTC or APTC) and Cost-Sharing Reductions (CSRs).

‍ ‍If the insured or their spouse works for a company that offers group health benefits, enrolling in the employer's health plan represents one of the strongest avenues, as the Health Insurance Marketplace's subsidy rules do not affect corporate policies.
